Article 1.
Any delivery is subjected to acceptance express train of these conditions of sale, the invoice acting as confirmation.
Article 2.
Except convention express train, the delay within the delivery periods cannot give place to allowance or cancellation of the order, and in particular in the following cases:
- the terms of payment were not observed
- cause beyond control or event suitable to delay or suspend the delivery of the goods
Article 3.
Our goods, even agreed free, travel to the risks and dangers of the recipient, to whom it belongs, in the event of damages or of losses, to make all reserves, and to exert any recourse near the conveyors only responsible.
Article 4.
The customer will have any faculty to take delivery of the goods at the time of the delivery. It rests him at this time to take after control the whole responsability for it.
Article 5.
The complaints concerning the quality and/or quantity of the goods, other than any litigation of transport, will have to be formulated in writing within 8 day starting from the delivery.
Article 6.
No return of goods could be carried out without our written assent, this assent not implying any responsibility.
Article 7.
Our invoices are payable at Company CACI 36 by transfer, or species, after prior agreement.
Article 8.
In the event of payment do nonof an invoice in its term, we reserve itself the right to increase its amount of 10% with a minimum of 45 € without damage of the post maturity interest.
Article 9.
In the event of extension of draft, the expenses and interests of this extension will be the responsibility of the purchaser.
Article 10.
When the credit of the purchaser worsens, we reserve ourselves the right, even after forwarding partial of an order, to require of the purchaser the guarantees that we judge suitable for the good execution of the commitments entered into. The refusal to satisfy there gives us the right to cancel whole or part of the market.
Article 11.
In the event of dispute, the courts of CHATEAUROUX are only qualified. For export: in the event of dispute, the courts of CHATEAUROUX are only qualified
Article 12.
The salesman reserves the property of the goods until the complete payment of the price. The risks are the responsibility of the purchaser. The installments could be preserved to cover the possible losses with the resale.
Article 13.
The exchange rate risk is the responsibility of the purchaser.
Article 14.
Nonthe payment of only one invoice in its term makes exigible automatically the balance due on all the other invoices.
Article 15.
In the event of export and of removal of the goods by the customer, the amount of the VAT exigible without guarantee from export, will be paid in guarantee by the customer near Company CACI 36 and will be restored to him with the return of the export licence duly validated by the Customs.
